Advocacy for the intersections between Labor Law and Business Law

The evolution of corporate governance is bringing Labor Law and Business Law closer together in an increasingly intense way. The article published in the "Organizational Law" column of the Migalhas newsletter and reported in the Business & Labor Clipping of June 30, 2026, analyzes how topics such as labor compliance, psychosocial risks, ESG, and occupational health have become part of the strategic core of organizations, requiring a cross-cutting legal approach—the so-called intersectional advocacy.

The strategic choices made by managers simultaneously impact the corporate, regulatory, labor, competition, and reputational spheres, requiring an integrated approach to legal counsel.

From this perspective, the so-called... “"advocacy of intersections"”, developed in an article by Ronald Sharp Jr published by the Migalhas Newsletter on June 29th, which proposes legal action precisely in the areas of convergence between different branches of law.

This reflection finds its basis, among other things, in the classic works of Alberto Asquini and Alfredo Rocco, for whom a company is not limited to assets organized for the production of wealth. It also represents an institutional organization composed of people, legal relationships, and interests that transcend the economic dimension.

If a company has both an institutional and human profile, the proper management of labor relations ceases to be solely a concern of the human resources department and becomes an integral part of the duty of diligence and prudent administration of its managers.

This reality is reinforced by recent regulatory developments related to occupational risk management, psychosocial risks, corporate integrity, and good governance practices, which significantly expand the strategic responsibility of senior management.

More than an academic trend, this is a structural change in the business environment.

The corporate lawyer of today — and, above all, of the future — needs to understand that many of the most relevant risks for organizations arise precisely in the areas of intersection between legal disciplines traditionally treated in isolation.

It is within this space of integration that a more preventive, strategic legal practice, effectively aligned with corporate governance, is built.
